Terms of Service

1. Acceptance of Terms

By accessing or using the Draftic AI service ("Service") operated by Draftic AI ("we", "us", "our") at draftic.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Account Registration

To use certain features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your login credentials secure and not share them with others
• Accept responsibility for all activity under your account
• Be at least 16 years of age

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent activity.

3. Subscriptions & Billing

Draftic AI offers Free and Ultimate plans. Paid plans are billed on a monthly or annual basis through Stripe.

• Free plan: Available at no cost with limited features and usage.
• Paid plans: Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date.
• Price changes: We will notify you at least 30 days before any price increase. You may cancel before the increase takes effect.
• Refunds: You may request a full refund within 7 days of a paid subscription purchase. After 7 days, no refunds are provided, but you retain access until the end of your billing period.
• Cancellation: You may cancel your subscription at any time from your account settings. Upon cancellation, access to paid features continues until the end of the current billing period, after which your account reverts to the Free plan.

4. Intellectual Property

Your Content

You retain ownership of all content you create or upload to the Service, including PRDs, templates, and knowledge base documents. You grant us a limited, non-exclusive license to process your content solely to provide the Service (e.g., sending prompts to AI providers, storing documents).

Our Service

The Draftic AI service, including its design, code, features, and documentation, is owned by Draftic AI and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

5. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described in our Privacy Policy. We do not sell your personal data. We do not use your content to train AI models.

6. Acceptable Use & Limitations

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws
• Attempt to circumvent usage limits, rate limits, or access controls
• Upload malicious files, viruses, or content intended to disrupt the Service
• Resell, sublicense, or redistribute the Service without written permission
• Use automated tools to scrape, crawl, or extract data from the Service
• Generate content that is harmful, abusive, discriminatory, or violates the rights of others

We reserve the right to suspend or terminate accounts that violate these restrictions.

7. Disclaimer & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that:

• AI-generated content will be accurate, complete, or fit for any particular purpose
• The Service will be uninterrupted or error-free
• Generated PRDs will meet specific regulatory or industry standards

To the maximum extent permitted by law, Draftic AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Termination

You may terminate your account at any time by deleting it from your account settings. We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after account deletion, after which it is permanently removed. You may export your content before deleting your account.

9. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes via email or an in-app notification at least 30 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Service and delete your account.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Delaware. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
